Federal Student Financial Aid Penalties for Drug Violations
The Higher Education Act of 1965 as amended (HEA) suspends financial aid eligibility for a student who has been convicted under federal or state law of the sale or possession of a controlled substance. If you have been convicted of these offenses, call the Federal Student Aid Information Center at (800) 4-FED-AID or go to www.fafsa.ed.gov to the Student Aid Eligibility Worksheet to find out if this law applies to you. Students convicted of these offenses may regain eligibility according to the information below:
If convicted of an offense involving the POSSESSION of a controlled substance, the ineligibility period is as follows:

If convicted of an offense involving the SALE of a controlled substance, the ineligibility period is as follows:

Rehabilitation
A student whose eligibility has been suspended may resume eligibility before the end of his/her eligibility period under the following circumstances:
*If the student satisfactorily completes a drug rehabilitation program and passes two unannounced drug tests conducted by a drug rehabilitation program.
*If the student’s conviction is reversed, set aside or otherwise rendered nugatory.
